Welcome to GuideMe. These Terms of Use (“Terms”) govern your access to and use of our website https://guideme.ma (the “Website”) and our WhatsApp-based travel assistant services (the “Service”). By accessing or using the Website or the Service, you agree to these Terms.

If you do not agree, please do not use GuideMe.


1) Who we are

2) The Service

GuideMe provides a WhatsApp-based assistant for travel in Morocco, including information and suggestions such as:

  • Local recommendations (places to visit, food, activities)

  • Navigation guidance and practical tips

  • Culture/etiquette and safety suggestions

  • Translation and language support

  • Explanations of signs/menus/images you share

GuideMe provides information and guidance only and does not replace professional advice (medical, legal, financial, or emergency services).


3) Eligibility

You must be at least 16 years old to use the Service. By using GuideMe, you confirm that you meet this requirement.


4) Access via WhatsApp

GuideMe is accessed through WhatsApp. Your use of WhatsApp is governed by WhatsApp/Meta’s terms and policies. We are not responsible for WhatsApp’s availability, outages, or changes to their platform or rules.

You are responsible for:

  • Maintaining access to your WhatsApp account/phone number and device

  • Any fees charged by your mobile carrier or internet provider


5) Free trial

We may offer a 30-minute free trial so you can test the Service.

The trial:

  • May be limited in features, speed, or capacity

  • Is intended for evaluation and onboarding

  • May be modified, paused, or discontinued at any time

If misuse is detected (spam, automation abuse, repeated trial attempts), we may restrict access.


6) Plans, credits, billing, and upgrades

Credits

If you purchase a plan or credit package, you receive a credit balance that is used across different message types (for example: text, location guidance, image analysis, voice messages).

  • Credits roll over (unused credits remain available), unless we clearly state otherwise on the Pricing page or at purchase.

  • Some features (such as voice and image) have different credit costs. You can use them as much as your credit balance allows.

  • Credit costs may vary based on message length/complexity and processing requirements.

Upgrades

You can upgrade anytime. Plan changes may take effect immediately or at the next billing cycle depending on your checkout flow and plan rules shown at purchase.

Payments

Payments may be processed through PayPal and/or Stripe (and any related checkout providers used on the Website). By purchasing, you agree to the applicable payment provider’s terms.

Taxes and fees

You are responsible for any taxes or fees required by law or your payment method.


7) Refunds (case-by-case)

Refunds are handled case by case. If you believe you were charged incorrectly or experienced a serious Service issue, contact [email protected] with:

  • The payment email/receipt

  • The date of purchase

  • A short description of the issue

We will review your request and respond within a reasonable timeframe. Approval is not guaranteed and may depend on usage, time since purchase, and the nature of the problem.


8) Acceptable use

You agree not to:

  • Use the Service for illegal activities or to violate any law/regulation

  • Harass, threaten, defame, or harm others

  • Send spam, scams, or misleading content

  • Attempt to reverse engineer, exploit, scrape, or disrupt the Service

  • Upload malware or malicious code

  • Request or distribute content that is hateful, violent, sexually exploitative, or otherwise unlawful

  • Share personal data of others without permission

We may suspend or terminate access if we believe you are misusing the Service.


9) Safety and emergency disclaimer

GuideMe is not an emergency service.

If you are in danger or need urgent help, contact local emergency services immediately. In Morocco, common emergency numbers include:

  • Police: 19

  • Ambulance/Fire: 15

You are responsible for decisions you make while traveling, including routes taken, purchases, bookings, and interactions with third parties.


10) Third-party services and links

GuideMe may recommend or link to third-party providers (restaurants, taxis, guides, hotels, booking platforms, maps). GuideMe:

  • Does not control third parties

  • Does not guarantee availability, pricing, safety, quality, or outcomes

  • Is not responsible for disputes between you and third parties

Always verify important details (prices, opening hours, reservations, local rules) before acting.


11) Content you provide

You may send messages, voice notes, images, and other content (“User Content”) to GuideMe.

You retain ownership of your User Content. By using the Service, you grant GuideMe a limited license to use your User Content to:

  • Provide the Service to you

  • Maintain, secure, and improve the Service (including quality and safety)

You confirm you have the right to share any content you send and that it does not infringe others’ rights.


12) Privacy

Our Privacy Policy explains how we collect and use data, including storing WhatsApp messages for service improvement. By using GuideMe, you agree to our Privacy Policy.


13) Intellectual property

The Website, Service, brand, and all related materials (excluding your User Content) are owned by GuideMe or licensed to GuideMe and protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from the Service without permission.


14) Service availability and changes

We aim to keep GuideMe reliable, but we do not guarantee uninterrupted availability. We may:

  • Modify, limit, or discontinue features

  • Perform maintenance that temporarily limits access

  • Update these Terms from time to time


15) Termination

You may stop using GuideMe at any time.

We may suspend or terminate access if:

  • You violate these Terms

  • We must do so to comply with law

  • It is necessary to protect users, the public, or our systems


16) Disclaimers

GuideMe is provided “as is” and “as available.” To the maximum extent permitted by law:

  • We do not warrant that the Service will always be accurate, complete, or error-free

  • We do not guarantee outcomes from using recommendations, translations, or guidance


17) Limitation of liability

To the maximum extent permitted by law, GuideMe will not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or goodwill

  • Damages arising from travel decisions, third-party services, or reliance on recommendations

Where liability cannot be excluded, our total liability will be limited to the amount you paid for the Service in the three (3) months before the event giving rise to the claim.


18) Indemnity

You agree to indemnify and hold harmless GuideMe from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your misuse of the Service

  • Your violation of these Terms

  • Your User Content


19) Governing law and jurisdiction

These Terms are governed by the laws of Morocco. Any dispute will be handled by the competent courts of Asilah, unless otherwise required by law.
